As a person enters the later stages of their life, they begin to think about the next generation and how to make sure that they are protected after they are gone.  While The Flannery Law Office is happy to give their older clients the type of peace of mind that having an estate plan can provide, we urge our younger clients to not overlook their estate planning.  While no one likes to think about it, we cannot know what the future may hold.  Whom do you want making the decisions when you can't speak for yourself?

 

If a person dies without a will, the state statutes determine how their property is divided, but takes no account of the wishes of the deceased.  They haven't been expressed in the proper form, so the state steps in to make the decisions.  Having a will allows you to determine what happens when you die.  Having a living will and/or a durable power of attorney for medical care allows you to voice your opinions when the worst happens.  Whether young or old, the benefits of an effective plan are the same.

 

Additionally, an effective estate plan can help your family in their time of need and grief.  Having your wishes already expressed allows your chosen representative to carry out your wishes, without having to first determine what they would have been and without having people argue over them.  It is in this way that your estate plan provides piece of mind, not only to you, but to your family as well.
